HOPS Privacy Notice

How HOPS collects, uses, and shares personal data, including the rights of data subjects.

Bangkok Hops Co., Ltd. is a company registered and incorporated in Thailand. Our company uses the trade name "HOPS" in conducting its business.

To inform you of how we process your personal data before you decide to use our services and allow us to process your personal data, HOPS, the "Company", or "we" have prepared this Privacy Notice to inform you that we may collect, use, share, and manage or control the processing of your personal data ("you") through websites, applications, other communication channels, and other channels, both online and offline.

The Company's purpose is to provide services and facilitate your booking, acquisition, purchase, payment, rental, use, or receipt of products, travel services, or services related to or connected with travel products or services, whether single or multiple types of products or services combined, which HOPS or other persons may provide ("Products and Services" collectively). Providers of Products and Services who are third parties include hotel and accommodation providers (such as hotels, motels, apartments, hostels, homestays, bed-and-breakfasts, and short-term rental accommodations), attraction and activity providers (such as theme parks, museums, and sightseeing tours), transportation providers (such as airlines, car rental providers, cruise lines, public buses, coaches, trains, and airport transfer services), tour operators, travel insurance underwriters, and other providers of products or services related to travel that may be offered through the Company's platform from time to time (collectively, "Partner Service Providers"). To enable you to fully understand the Products and Services that the Company offers, including features, functions, and the use of the platform.

Please review the Company's Terms and Conditions of Service. In the event that this Privacy Notice and the Terms and Conditions of Service contain conflicting or inconsistent statements, definitions, or terms regarding Products and Services, the Terms and Conditions of Service shall prevail over this Privacy Notice.

The Company will examine and review this Privacy Notice. Where necessary, the Company will update and amend the provisions of this Privacy Notice in order to be consistent with the management and processing of your personal data and/or to be consistent with amendments to applicable laws. Therefore, please review this Privacy Notice to study, understand, and become familiar with the way the Company processes your personal data.

Purpose and Scope of this Privacy Notice

This Notice applies to users of the HOPS platform who are natural persons, including customers who purchase or book Products and Services on the platform without registering a user account or signing in to a user account, visitors to the Company's website and/or application, (legal) representatives or contacts acting on behalf of the Company's users or customers, and persons involved in other transactions with the Company, such as service providers, suppliers of goods and services, suppliers of Products and Services, and/or business partners of the Company.

In the case where you are an organization or a juristic person, this Privacy Notice applies to the processing of personal data of natural persons related to you (such as the juristic person's representative, authorized director, or person designated by you as the principal contact), and the term "you" shall include such natural persons related to your organization or juristic person.

The Company may receive your personal data through the following methods:

Directly from you, when you register and/or use the Company's platform, purchase or book any Products and Services, fill in forms, prepare or sign any contract with the Company, contact the Company through any of its communication channels, or interact with the Company through social media.

Indirectly from your representative, when such representative pays for Products and Services on your behalf, or from your employer, in the event that your employer is or will be a customer/business partner or Partner Service Provider with the Company and you are designated as the principal contact for your employer.

From other sources, such as online or traditional media, cookies and similar technologies, through the Company's website and applications, public databases or sources, or other third parties, such as payment or transaction service providers or processors, financial institutions, commercial companies or entities, government agencies, registration or login through third-party services, or from records or photographs taken by the Company during activities or events, or from CCTV cameras installed at the Company's business premises.

2. Personal Data the Company Processes

The term "personal data" means information, data, or any opinions that the Company has received from or about you, or that can reasonably be used to identify you, regardless of whether your personal data is accurate, and regardless of the form in which the data is stored. Such personal data may be a single set of data and/or multiple sets of data combined that can identify or refer to you, whether directly or indirectly. The Company will process your personal data to fulfil your request, or pursuant to the contract the Company has with you to provide specific Products and Services, in the following cases:

Identification data

The Company will request basic personal data from you, including your full name and email address or telephone number, in order to create a user account on our platform. However, the Company may need to request additional information from you, such as your date of birth, place of birth, nationality, or the names of your travel companions, when you purchase or book certain types of Products and Services on the platform. In some cases, the Company may need to request government-issued documents, such as a national ID card, passport or passport number, or driver's license, in accordance with the booking or purchasing procedures of Partner Service Providers, or for the purpose of refund requests, insurance claims, or cancellation of any bookings or purchases of Products and Services. In addition, the Company may process such personal data in accordance with its know-your-customer (KYC) procedures, which the Company must perform and comply with under applicable laws, or in accordance with the conditions specified in the Company's Terms and Conditions of Service, in order to prevent fraud or behavior that may contravene international sanctions or trade measures, and to comply with regulations, including laws and regulations on the prevention and suppression of money laundering, financing of terrorism, and tax fraud.

Transaction information

Booking ID and your booking details (such as hotel name, hotel location, length of stay, and activity packages you booked or purchased), including your booking and purchase history of Products and Services, and your insurance policies, such as policyholder and beneficiary details, coverage information, policy number, and information related to insurance claims.

Payment information

Including bank account number and/or electronic payment information, such as credit or debit card number, expiry date, billing address, and other relevant transaction details.

User-generated content (information, content, or work created by the user)

When you submit any data, content, or creative work via HOPS features or use other related features on our application, such as photographs, videos, or other user-generated content, such as comments or reviews, the Company may collect your user account information (such as your full name, username, or display name used at the time of submission), interaction data (such as engagement data, number of likes, replies, or reports related to that content, as well as timestamps and information about the device you use) when you submit any data, content, or creative work.

Other information

Information you provide through filling in forms, information in your user account including your photographs, survey responses, participation in promotions, as well as communications with the Company through messaging, other communication channels, or social media, including suggestions or comments about your service experience. We may use this information to help you plan and manage your travel, or to book or purchase Products and Services more efficiently, including participating in future activities.

When you share other people's personal data with the Company, such as your travel companions, you agree, represent, and warrant that you have obtained consent from those persons to share and disclose such personal data to the Company, and that you have informed them and ensured they understand HOPS' use and processing of personal data in accordance with this Privacy Notice.

In addition, if you apply for a job with the Company, or if you are an employee of ours, the Company will process your personal data as follows:

Additional personal data, contact details, and identification information

In addition to the personal data specified above, the Company may collect additional personal data for recruitment and employment purposes, such as national ID number, social security number, insurance information, marital status, spouse or dependents, and emergency contact details.

Educational data, and information about relevant background and work experience

The Company may collect educational data and professional or employment-related information, such as your employment history.

Sensitive data for recruitment and employment purposes

The Company may collect certain types of sensitive personal data where permitted by law or with your consent, such as health or medical information (including disability information), trade union membership, religion, race or ethnicity, and information about criminal offences and criminal cases. The Company collects this information for specific purposes, for example, the Company collects health or medical data for benefits administration and background checking, and the Company collects personal data related to diversity (such as race and ethnicity) to comply with legal obligations and internal policies on anti-discrimination.

Talent management information

The Company may collect information necessary for background checks, decision-making, and work performance results, performance feedback and warning letters, information from e-learning or training programs, and information used in preparing personal biographies.

Sensitive personal data. Some of the personal data mentioned above, such as government-issued ID cards, financial information, and health information, may be classified as sensitive personal data or special category data under applicable laws and regulations in some countries. Please be aware that this personal data may be required for booking or purchasing certain types of Products and Services, or for processing your job application, and the Company may not be able to complete the booking or recruitment process without receiving such information from you.

Information of minors. The Company does not provide services to minors who do not have legal capacity to give consent and have not yet attained the age of majority and the readiness to understand the Terms and Conditions for Products and Services and this Privacy Notice. The Company will only collect personal data of minors when you provide information about your child or a minor under your care. If you are aware that your child or a minor under your care has provided personal data to the Company without your consent, please contact the Company at the contact details below.

Personal data that the Company collects from your devices

Each time you visit our website or application, the Company will collect certain types of information to provide you with a better and more convenient platform experience, or to maintain security measures. Such information may include:

Geographic location, in order to provide you with the most appropriate offers and experiences, such as offering travel information, recommending activities or attractions near your location.

Log data, such as IP address, browser type, operating system, country, web pages visited, the date and time you accessed the Company's services, as well as other information related to internet usage.

Cookies and similar technologies. You can manage cookie settings through your browser, such as Internet Explorer, Safari, Firefox, or Chrome, to help track your internet usage behavior, to make the Company's website and applications work properly and securely, and to improve the Company's services, including presenting messages, advertisements, or banners that match your interests, by being able to choose which types of cookies to accept or reject. If you choose to block functionality cookies, you may be unable to use certain features or services on the Company's platform.

Device and installed application information. Information from your phone and/or from the HOPS application installed on your device may be collected to identify the device, including device-specific settings, device characteristics, application crashes, and other related system activities.

Personal data the Company receives from third parties or other sources

Generally, the Company collects personal data voluntarily and directly from you, except for certain information that the Company collects from third parties or various public information sources, such as:

Partner Service Providers, business partners, affiliates, other service providers, and/or other persons who cooperate with the Company under contracts or other obligations to support the provision of Products and Services.

Third-party service providers, such as Google, Apple, or Facebook, and other service providers, in cases where you choose to log in or connect to the Company's platform through such services.

Referrers or travel companions, when you receive an invitation or email from the Company as a travel companion from a booking or purchase of Products and Services made by a person who has provided your personal data to the Company.

Your advisors (including but not limited to accountants, auditors, lawyers, financial advisors, or other professional advisors) authorized by you.

Your employer, as part of your registration or booking process for corporate travel services.

Any person you have indicated as your authorized representative, or who pays for Products and Services on your behalf.

Third-party providers regarding certain financial information, when you register for, add, and/or link (as applicable) payment cards, credit products, insurance, or other financial products or accounts with the Company.

Photographs and videos that the Company records during HOPS-organized activities or events, and CCTV recordings inside HOPS' business premises.

Why the Company Processes Your Personal Data

Processing means any activity that can be performed in relation to personal data, such as collection, recording, retention, updating, organization, use, disclosure, transfer, or deletion, in accordance with applicable laws and regulations. Generally, the Company will use your personal data only in accordance with your request, as set out in the Terms and Conditions of Service that you have accepted and agreed to be bound by and comply with, including but not limited to the purposes specified below.

You may choose not to provide certain types of personal data to us, as set out in Section 2. However, you acknowledge that the Company may need to use personal data to act on your request when you book or purchase Products and Services on the platform, including sensitive personal data, in order for the Company to be able to perform its obligations in accordance with your request and/or perform its contractual obligations to you, as set out below. Otherwise, you may not be able to book, purchase, use, or receive such Products and Services.

Performance of the Company's Contract with You

Booking or purchasing Products and Services. The Company uses your personal data to provide and facilitate your booking or purchase of Products and Services online on the Company's platform, including verifying your user account, registering you as a user, and/or sending you booking confirmations or emails as evidence of your booking or purchase of Products and Services, or to confirm receipt of payment from you. The Company may process your personal data to enable online check-in with Partner Service Providers, and/or to process refunds to you.

User account management. When you create a user account with the Company, you can manage your user account settings, including updating the home page of your user account and customizing your platform experience, such as publishing your reviews about the Company's services and the Products and Services offered on the platform. When you book or purchase Products and Services without signing in to your user account, the Company will use your information to enable you to easily access details of the trip or service you have booked or purchased, and related benefits, including facilitating the allocation of reward points (if any) so that eligible users can receive maximum benefits.

Payment on the platform. When you book Products and Services through the Company's platform, the Company will securely collect and process your payment information, including credit card information, in order to complete your booking or purchase of Products and Services. In some cases, we may collect and process additional payment information from you (such as details about the location where you made the transaction) in order to comply with the requirements of payment service providers and/or our Partner Service Providers, and/or to enhance the security level of payment processing.

Customer service. The Company uses your personal data to respond to your inquiries or requests regarding your booking via email, push notifications, chatbots, or telephone, and to share such information with Partner Service Providers, as well as to handle errors or problems you may encounter when using the Company's services, and to measure and improve your experience and satisfaction.

Compliance with the Company's Legal Obligations

The Company uses your personal data to comply with legal obligations and various requirements that the Company is required to perform, including:

Identity verification. The Company processes personal data, such as telephone number, email address, device information, and login credentials, for the purpose of verifying identity and maintaining security in accessing your user account, including sending verification codes, login notifications, and other security-related notifications, in order to protect your account from unauthorized access. To enable such notifications to be sent quickly and securely, the Company may use one or more communication channels, such as email, device notifications, inbox notifications, or other supported methods. However, please note that the Company cannot provide all forms of notification through every channel at all times. The Company recommends that users enable and maintain access to all available communication channels (especially adding a verified email address and enabling notifications). For certain types of Products and Services, the Company may need to use identity verification information from third parties (such as financial institutions) to verify your identity.

Fraud prevention and anti-money laundering and counter-terrorism financing checks. The Company has a legal duty to monitor and prevent money laundering, financing of terrorism, fraud, inappropriate behavior, harmful or unlawful activities, and to protect the rights of the Company. Therefore, the Company may monitor unusual transactions that users or you carry out through the HOPS platform.

Compliance with requests from government authorities and legal disputes. The Company has legal obligations to respond to legal requests from government authorities, as well as for the resolution of disputes, legal proceedings, and the management of complaints.

Legitimate Interests of the Company

The Company processes your personal data for several purposes related to the Company's legitimate interests in performing contractual obligations as set out below. When the Company relies on the legitimate interests basis for processing data, the Company will process personal data appropriately, with strict respect for your fundamental rights and freedoms.

To develop and improve the Company's Products and Services. The Company may use your personal data to analyze your usage through the Company's website or application, with the aim of improving these services through the use of cookies and/or similar technologies. In addition, the Company may request your feedback and/or reviews regarding your experience using the Products and Services of the Company or of Partner Service Providers, and use such information to test the operation of systems and to compile business statistics, in order to support development, operational improvements, and the evaluation of service performance. The Company is committed to using only de-identified personal data in such analyses.

To achieve such purposes, the Company may combine personal data obtained from you during multiple uses of the Company's platform or from various devices, even if you have not signed in.

To enhance operational efficiency and improve user experience in various functions, including providing services to the Company's customers and employees. The Company uses Artificial Intelligence (AI) and Machine Learning (ML) technologies to enhance operational efficiency, faster responses, and improvement of the Company's service delivery, while still maintaining appropriate safeguards to protect personal data.

In general cases, the Company's AI and ML operate without processing personal data. These technologies operate by analyzing general patterns, enabling automation of repetitive tasks and providing insights to enhance efficiency. For example, the Company will use AI and ML for the following purposes:

Providing chatbots for customer engagement, communication, and offering Products and Services that are more tailored to the customer, and to improve self-service options.

Automating employee processes for administrative tasks, such as drafting initial job descriptions, recommending learning opportunities, and supporting talent management.

Optimizing operations to identify trends and improve internal processes, without relying on personal data.

In some cases where AI may need to involve or process personal data, the Company will take steps to assure you that such processing complies with Data Minimization Principles, and we have established appropriate control measures, such as anonymization or pseudonymization of personal data. In addition, the Company's AI will not make fully automated decisions without human review and verification.

To promote and present the most appropriate offers from the Company or from the Company's travel service providers. The Company will process your personal data to present information or recommendations regarding relevant Products and Services, such as hotels, flights, other transportation services, and attractions and activities, or Product and Service prices that are appropriate for you, including travel and lifestyle packages, financial services, and payment channels that match your needs. The Company is committed to better understanding you and responding to your ever-changing needs by offering Products and Services tailored to your specific situation. In order to appropriately tailor offers, the Company may take the following actions:

Analyze your behavior, searches, and preferences through various communication channels, including visits to the Company's website and mobile application.

Analyze the Products and Services you have booked or purchased from the Company.

4. To enforce the Terms and Conditions of Service of the HOPS platform, Community Guidelines, or specific policies for other products, such as the accommodation or flight refund procedures, or other terms of use.

5. To fulfil duties and responsibilities owed or due between you and the Company, Partner Service Providers, or the Company's business partners, including but not limited to processing transactions, providing services as agreed, managing bookings, processing payments, handling disputes, and complying with relevant policies or terms and conditions as specified.

To respect your decisions in cases where the Company asks for your consent

The Company may communicate with you through electronic messages, such as email, messages, or mobile push notifications, in accordance with the purposes specified above and as permitted by relevant law, in order to:

Send information related to the Company's Products and Services, which may include confirmations and updates of your bookings, receipts, notifications regarding technical matters, updates, security alerts, and support and administrator messages. Please note that communications related to your booking are necessary for the purposes of performing the contract the Company has with you.

Send marketing communications. In other cases, with your consent and as permitted by applicable law, the Company may communicate with you about offers, promotions, rewards, upcoming campaigns or activities, market research or surveys, and other news regarding Products and Services offered by the Company, its affiliates, Partner Service Providers, and other business partners of the Company.

You can manage and review your notification settings through the notification settings in your user account, where you can turn each notification on or off as desired, or opt out of marketing communications by choosing not to receive further notifications, advertising, or marketing materials, or by following the instructions specified in the Company's marketing materials. Please note that the Company may need time after you manage the above settings to give effect to the changes in accordance with your wishes. If you change your mind and modify the settings again, you may still receive communications that the Company has scheduled in advance before you make the above setting changes.

Sharing of Your Personal Data

In some cases, the Company is required to disclose or transfer your personal data to other persons involved in the provision of the Company's services, which may include disclosure or transfer of data within the Bangkok Hops Co., Ltd. group and to third parties. Each such sharing of data will be carried out on the appropriate legal basis, as specified (Why the Company Processes Your Personal Data).

Sharing of Personal Data within the Bangkok Hops Co., Ltd. Group

The Company is committed to protecting your privacy by adopting an internal data privacy policy that is in line with personal data protection principles and is binding on Bangkok Hops Co., Ltd. The Company may share your personal data within Bangkok Hops Co., Ltd. to enable us to perform our legal obligations, such as:

To centralize certain operational and administrative tasks at the Bangkok Hops Co., Ltd. processing center, strictly subject to the internal data privacy policy of Bangkok Hops Co., Ltd., to ensure that adequate data protection measures are in place.

Storage and maintenance of server systems, technical support and customer support, including data analysis, product improvement, and overall maintenance of the Company's platform.

The Company may use centralized data storage systems for processing data at a central location within the Bangkok Hops Co., Ltd. group. These systems may be operated by Bangkok Hops Co., Ltd. or by third parties, and may be located outside the country in which you use our services. However, the Company will ensure that appropriate and adequate measures are in place to protect your personal data.

Sharing of Personal Data with Third Parties

The Company may share your personal data with the following third parties:

Government and regulatory authorities, in order to comply with reporting requirements and requests for information issued by domestic regulatory authorities, such as tax authorities, judicial/legal/investigation/inquiry authorities such as police, prosecutors, courts, and arbitration or mediation bodies, unless such authorities request information at the individual level specifically, the Company will compile aggregated information, meaning sharing data only at the customer (or employee, as appropriate) group level so that individuals cannot be identified.

Partner Service Providers with whom you have booked or purchased Products and Services, such as hotels, airlines, other transportation providers, including activity or attraction providers, in order to facilitate the booking and provide services to you. The Company recommends that you read the privacy notices of those service providers to understand how those persons process your personal data.

Business partners, channel managers, intermediaries, or other connectivity service providers that distribute the Company's services, including connecting and managing your bookings with Partner Service Providers.

Service providers and other third parties that support the Company's normal business operations, such as cloud infrastructure services, customer support and communications services, fraud detection and prevention, management of insurance claims, as well as financial institutions that support certain payment processes or provide financial services to the Company.

Specialized third parties, such as law firms or auditors, to whom your personal data will be disclosed only as necessary, and these persons will process your data under their professional duties.

Marketing and advertising partners, in order to be able to display relevant advertisements to target audiences.

Cross-Border Transfer of Data

The personal data that the Company collects may be stored on servers located outside the country where you reside or use our services, for your benefit and/or for necessary purposes in concluding or performing the contract that the Company has with you, including between the group of companies and third parties as specified (Sharing of Your Personal Data). Your personal data may be transferred or transmitted to, or accessible in, other countries where the Company or Partner Service Providers conduct business. The Company will use appropriate contractual, organizational, and technical measures (such as data encryption) to ensure that your personal data continues to be adequately protected.

Your Rights and How the Company Protects Your Rights

According to the provisions of relevant laws and regulations, your rights regarding personal data may vary depending on the country in which you reside or transact. If you have questions regarding your various rights, please contact the Company through the email address specified. In general, you have the following rights:

You may request access to and request a copy of your personal data that the Company processes. Each request will be considered on a case-by-case basis, and the Company may need to perform additional identity verification for the security of your data. Please note that some types of data may be subject to legal data retention requirements or operational requirements, which may affect the scope of the data the Company can provide to you. In addition, the Company may charge a processing fee depending on the nature and volume of the information requested, as permitted by applicable law.

You may request that the Company correct your personal data related to your user account. If you find that your information is inaccurate or incomplete, you can configure settings via the Company's application, where you can amend most of your information yourself easily. For some types of personal data that you cannot amend yourself, you can contact the Company for assistance. However, if such personal data relates to a booking or purchase of Products and Services from a Partner Service Provider, the amendment of such information must be carried out in accordance with the policy of that service provider.

In some cases, you may request that the Company delete personal data that the Company holds about you. If you wish to terminate your HOPS user account and related data, you can do so via the "Delete Account" option in the application's settings page or by logging in via the Company's website. However, some information may be retained for the period (Retention of Your Personal Data).

In some cases, you may object to the use of your personal data if there is a reasonable ground. The Company will consider your objection and assess whether the processing of your data has a disproportionate impact, which would require the Company to stop processing your data. However, you cannot exercise this right of objection if the Company is required to process your data as required by law or to perform a contract with you.

In some cases, you may request that the Company restrict the use of your personal data, for example, when you contest the accuracy or lawfulness of the processing of your personal data, or if you believe that your data is no longer relevant to the Company, or if you have asked the Company to stop using such data. The Company will not use or disclose your personal data in any other manner during the period in which the use of such data is restricted, but the Company may not be able to provide certain services or products as you have requested during the period in which such restriction is in place.

You may withdraw your consent to the processing of your personal data, if such processing by the Company is based on your consent. However, withdrawal of such consent will not affect the processing of personal data carried out lawfully prior to the withdrawal of consent. And please note that, if you withdraw consent, you may not be able to receive information regarding the Company's Products and Services through electronic messages, and you may miss information about offers, promotions, and various rewards from the Company.

You acknowledge and represent that all your requests to exercise rights have been carefully screened and reviewed. Therefore, when the Company has received your request, the Company may ask you to provide additional information or documents to verify your identity and authority to make the request. Once the Company has reviewed the request, the Company will determine whether the request is reasonable and will respond to your request within the timeframe prescribed by relevant law.

If you have any requests related to this Privacy Notice, wish to exercise any of your rights, or if you have a complaint, please contact us through the contact details specified below.

If you are not satisfied with the action taken or the response to your complaint, you have the right to lodge a complaint with the personal data protection authority in your country.

Retention of Your Personal Data

The Company will retain your personal data, including sensitive personal data, only as long as necessary for the purposes for which the Company collected and processed such data, and in accordance with relevant laws, to enforce the Company's legal rights when there is a necessary reason for retention, to protect the interests of the Company or you, such as in handling problems or defending against potential claims, and to comply with legal, tax, reporting, or auditing obligations that the Company must comply with, such as anti-money laundering laws, which require the Company to keep records of your transactions for a certain period before they can be deleted.

When the Company no longer has a need to use your data, the Company will delete such data from the Company's systems and records to the extent possible, and/or deactivate it, or take other reasonable steps to anonymize the data so that you can no longer be identified. Please also note that information you have previously shared with other users, such as reviews or posted content, may continue to appear publicly on the HOPS platform even after your user account has been terminated.

Protection of Your Personal Data

The Company protects your personal data by taking the following actions:

Organizational measures. The Company has dedicated personnel and units responsible for managing your personal data, in order to ensure that your personal data is properly handled from the collection stage through to retention. The Company's employees have a duty of confidentiality and cannot disclose personal data unlawfully. The Company regularly reviews its internal organizational framework to align with changing regulations and market developments.

Technical measures. The Company protects your personal data by implementing appropriate security measures, both physical, technical, and organizational, to ensure the availability, confidentiality, and integrity of your personal data, by limiting access to data only to authorized personnel. In addition, the Company also has specialized information security infrastructure providers for the secure processing and storage of your personal data.

To help the Company continuously protect your personal data, please contact the Company immediately if you suspect that your personal data may have been breached or accessed without authorization.

Links to Other Websites or Platforms

You may link your HOPS account with certain third-party services, and our platform may contain links connecting to third-party websites or platforms.
