Terms of Service
The primary contract between users and HOPS, covering platform use, bookings, payments, and liability.

Terms and Conditions of Service
Bangkok Hops Co., Ltd., or "we" or "HOPS", develops and manages the website www.bangkokhops.com/th and the HOPS application (the "Platform").
You, as a user of the Platform ("you" or "User"), acknowledge and agree that you have read and understood these Terms and Conditions of Service (the "Terms"), as well as the policies, agreements, and other terms and conditions referred to in these Terms. When you access, search, use, or carry out any transactions on the Platform, you agree and accept these Terms, and the policies, agreements, and other terms and conditions to which we refer or to which we provide links in the Terms. The policies, agreements, and other terms and conditions referred to in these Terms constitute a legally binding contract between you and Bangkok Hops Co., Ltd., or "we" or "HOPS".
Before or whenever you use or carry out any transaction on the Platform, please review these Terms in order to acknowledge and agree to the most recent updated version. At any time, HOPS may amend or change these Terms, in whole or in part, as necessary to comply with applicable law and/or to align with our various services. HOPS will reasonably notify Users of the most recent updated Terms on the Platform, and the most recent updated Terms shall prevail over all previous versions.
Platform and Services of HOPS
1.1 HOPS manages and provides an online platform to connect you with various service providers. We provide and facilitate your selection, search, booking, purchase, participation in activities, including payment, or in some cases, direct you to other distribution channels of service providers, so that you can book, purchase, participate in activities, or pay for the following types of products (the "Services"):
"Travel Products" depending on the country where we provide services, including but not limited to:
Flights, including air tickets for domestic and international flights, other ancillary services, and additional services that make your travel more flexible (flexible travel services), including baggage or luggage allowance, seat selection services, meals, additional special requests, ticket subclasses, and other ancillary services that HOPS provides as part of a flight (regardless of how those services are named).
Land transportation services, including but not limited to car rental services, airport transfer services, shuttle services, taxis, trains, buses and tour buses, other ancillary services related to the aforementioned land transportation services, and other ancillary services that HOPS provides as part of land transportation services.
Hotels, including temporary accommodation, hotels, resorts, apartments, villas, residences, or temporary rooms, ancillary or additional services, additional in-room amenities, special requests related to various types of hotel services, and other ancillary services related to hotel bookings that HOPS provides as part of hotel services.
Attractions and activities, including admission tickets to attractions, theme park tickets, event tickets, tour packages, cruise services, playgrounds, games and activities, recreational and cultural sports, spa and relaxation, other ancillary services related to attractions and activities, and other travel support services that HOPS provides as part of attractions and activities, or
More than one of the above products, or combined with other non-financial products and services that may be offered to Users for booking or purchase on the HOPS Platform, whether offered in a bundled form or otherwise.
"Financial Services" include lending, insurance (whether travel-related or not), and other financial products and services that we may offer to Users for booking or purchase on the Platform, with the products and services depending on the country in which we offer them to you.
"Activities" include games, campaigns, promotions, and any form of activity that we may organize from time to time, or carry out on the Platform, and/or other platforms, marketing channels, and various social media of HOPS.
"Other Products" include gift cards, travel vouchers, baggage and luggage tracking services, visa application services, international data plans, travel guides, discount packages, and other products or services that HOPS provides as part of Other Products.
In these Terms, we refer to Travel Products, Financial Services, Activities, and Other Products, separately or collectively, as "Products". A reference to Products may include the offering of multiple types of products combined (bundled), such as offering flights together with financial services or insurance, etc.
For the various services on this Platform, Bangkok Hops Co., Ltd., a company registered and incorporated in Thailand, will provide all or part of the services to you.
1.2 Third-party service providers will procure, manage, operate, or provide Products directly to you (each individually or collectively referred to as a "Partner Service Provider"). Unless HOPS has expressly stated on the Platform that HOPS itself procures and provides the Product to you, where the Partner Service Provider or HOPS (as applicable) has not specified terms or conditions for any Product in these Terms, HOPS or the Partner Service Provider will inform you of the specific terms of that Product (whether separately from these Terms or specified together with the Product details) (the "Product Conditions"), and we shall deem you to acknowledge and agree to those Product Conditions when you book, participate in, or purchase that Product, and/or you have received the Booking Confirmation. You will receive a "Booking Confirmation" when we issue a payment receipt, booking/purchase confirmation, and/or electronic ticket, voucher, or electronic admission pass to various venues (as applicable), which we send to you by email (to the email address you registered or entered at the time of booking), the My Bookings feature on the Platform, and/or any other method we may provide in the future.
1.3 Only Users who have reached the age of legal majority and have full legal capacity may access and use any of our Services on the Platform. In cases where applicable law restricts age, specifies restrictions, or prescribes additional qualifications of Users specifically for certain Products, in such cases we will notify you of the additional restrictions in these Terms, or in the Product Conditions, or use reasonable efforts to inform you of the basic qualifications and limitations of the Users who can use such Product Services. All actions, participation, bookings, purchases, and any transactions you carry out on the Platform shall be effective and bind you under these Terms. If you are a minor, a quasi-incompetent person, an incompetent person, or otherwise lack capacity or have not reached the age threshold to use our Services, we do not permit you to access and use the Services, use, or carry out any transactions, or book, participate in, or purchase any Products on the Platform.
1.4 You acknowledge that Partner Service Providers, agents, intermediary aggregators, distributors, sales channel providers, or other service providers of Partner Service Providers are the persons providing various information about the Products offered on the Platform. Therefore, we do not represent or warrant that information about Products received from Partner Service Providers, including agents, intermediary aggregators, distributors, sales channel providers, or other service providers of Partner Service Providers, is accurate, complete, available, up-to-date, or wholly true. HOPS shall not be responsible or have liability for any errors (including errors or defects in the compilation and presentation of information, and misspellings), technical or system errors (whether caused by damage, repair, or improvement of the Platform, whether temporary, and/or arising from total or partial errors), inaccurate, incomplete, misleading, or false product information, whether such product information is received from Partner Service Providers, agents, intermediary aggregators, distributors, sales channel providers, or other service providers of Partner Service Providers. In the event that you experience problems or issues regarding the Products of a Partner Service Provider, we will help you coordinate with the Partner Service Provider to resolve the problems or issues, but we do not represent and/or warrant and/or have any liability arising from such coordination, facilitation, or the outcome or resolution by the Partner Service Provider, whether you are satisfied or not.
1.5 You acknowledge that prices and details of Products will change in accordance with market mechanisms, consumer demand, the policies of Partner Service Providers, or other circumstances, which may result in the information presented on the Platform being incomplete, inaccurate, and/or out of date. The price or specific details of Products displayed on the homepage of the Platform, or displayed during browsing or searching for Products, may change by the time you proceed to the payment page. You must carefully and thoroughly check the final price before paying for the Product you have booked or purchased, including verifying that the final price may not be a correct or accurate price, but rather one that any reasonable person would know to be an unreasonable price for the Product, and you should not book or purchase that Product (a "Manifest Error"). In the event of a Manifest Error and you book or purchase that Product, you acknowledge and agree that HOPS shall not be responsible or liable for any booking or purchase of Products that you have agreed to, accepted, and successfully paid for on the Platform (Booking and Purchase of Products on the Platform) under these Terms. HOPS may cancel or refuse a booking or purchase of a Product caused by a Manifest Error, regardless of whose fault caused the Manifest Error.
1.6 HOPS, including the Platform and Services. We do not recommend or endorse any Partner Service Provider that offers Products on our Platform. We do not warrant, and there is no conduct on our part by which we represent, or by which you may interpret, that we provide recommendations or suggestions regarding the quality, level of service, or ranking of Products and/or Partner Service Providers on the Platform. In no case shall we be responsible or liable for any information, content, products, services, or messages provided or prepared by Partner Service Providers. The ranking of Partner Service Providers presented to you on the Platform will depend on various factors, including but not limited to your search query, destination, travel dates, availability of services from Partner Service Providers, type of service, and filters you enter while searching for Products on the Platform, which we believe will provide you with convenience and satisfaction in selecting the Products of relevant Partner Service Providers as you wish. In addition to the above, the Platform may present Products and Partner Service Providers based on various factors, including but not limited to popularity, location, price, accommodation type, user reviews, hotel star ratings, promotions (as defined below), and specific marketing campaigns and programs in which each Partner Service Provider participates with us. In cases where Partner Service Providers participate in special programs of HOPS to improve their ranking or help Users see their Products on the Platform more, we will display marks or symbols on the Platform to inform Users.
1.7 Rankings, special privileges, symbols, and other types of certifications that Partner Service Providers have received and/or that are displayed on the Platform are based on information that Partner Service Providers submit to HOPS, comments published by Users on the Platform, and other platforms that allow customers to comment on the Products of Partner Service Providers. HOPS has sole discretion to publish such information on the Platform. We do not certify or have any duty to verify the rankings, special privileges, symbols, and other types of certifications that Partner Service Providers have received, and shall not be responsible or liable for the accuracy of the rankings, special privileges, symbols, and other types of certifications. In no case shall HOPS be responsible or liable for any claims, damages, or liabilities related to the rankings, special privileges, symbols, and/or other types of certifications of Partner Service Providers displayed on the Platform. In addition to the rankings, special privileges, symbols, and other types of certifications of Partner Service Providers displayed on the Platform, you should consider other details of the Partner Service Providers and Products before proceeding to book or purchase Products.
1.8 You shall bear the risk of accessing content and information displayed on the Platform, and if other persons receive damage from your use of the Platform, you alone shall be responsible for any damage caused to those persons. To the extent we can limit liability under the law, in no event shall we be responsible for any damage arising from your use or your access to any content on our Platform, including, we shall not be responsible for any damage arising from errors or incompleteness of the information or content you can access on the Platform, including in cases where there are additions, deletions, or modifications of content or information that we operate and display on the Platform. We do not warrant that our Platform and Services will be available at all times or can be used continuously without any interruptions, and we shall not be responsible for damage you receive as a result of our Platform or Services being unavailable or experiencing interruptions in the use of our Platform and Services.
1.9 HOPS may present advertisements and links on the Platform to connect or direct you to other websites or platforms operated by third parties. In some cases, HOPS may cooperate with our partners or affiliates by allowing such partners or affiliates to offer advertisements and links to connect or direct you to other websites or platforms of those partners or affiliates. We may agree with partners or affiliates to display advertisements in still images or still images with links to connect and/or direct you to a particular page on our Platform, and/or on the platform of our partner or affiliate, and/or advertisements or marketing activities displayed or published on the Platform, and/or other marketing channels of ours that we have received support for from partners or affiliates. You can click on the advertisement or link to learn more about the advertiser, the owner of the product, and details of the goods and services of that person. In no event shall HOPS have control over a third-party platform, including the content, personal data protection, or other activities occurring on the third-party platform. Therefore, when you access a third-party platform by clicking on a link on HOPS' Platform, you acknowledge that the terms and conditions of that platform may apply to you, which terms and conditions are a separate agreement and unrelated to HOPS or these Terms, and you may be subject to the privacy policy or cookie policy of that third-party platform. We recommend that you read and understand the various policies of other platforms before using their services. When you access another person's platform, you assume the risk of accessing and using such platform, and you agree that we shall not be responsible for the content, access, or availability of such platform. We do not endorse or recommend, and shall not be responsible for, the source of the platform or the content on that platform, or the risk of receiving viruses, spyware, malware, or other risks from the platform or content on the platform. In addition, you agree to release us from all liabilities, expenses, claims, or damages incurred whether directly or indirectly, or alleged to have occurred from or in connection with your use of that platform, including the content, operation of the platform, or other matters on that platform. In some cases, we may display certain advertisements specifically to you, based on your interests or activities on the Platform. We will do this in accordance with HOPS' Privacy Notice.
Booking and Purchase of Products on the Platform
2.1 You agree that the use, booking, or purchase of any Product on the Platform constitutes a contract or transaction between you and (1) the Partner Service Provider specified on the Platform, or (2) HOPS, in cases where it is a Product that HOPS provides to you directly. In case (1), HOPS will only act as the operator of the Platform or the intermediary that facilitates your booking or purchase of Products between you and the Partner Service Provider. HOPS has no duty to procure, operate, provide services for, manage, own, be involved with, or control the Products you book or purchase through our Platform. HOPS shall have such duties only in cases where HOPS itself provides the Product to you directly under (2).
2.2 When you book or purchase a Product through the Platform, you accept and agree to the Product Conditions, including amendments to the Product Conditions, policies regarding cancellation, refund, no-show (failure to present yourself for service), or specific request conditions as set by that Partner Service Provider, or as HOPS may notify you on behalf of the Partner Service Provider at the time you book or purchase a Product through the Platform. When you receive the Booking Confirmation, we shall deem that you have read, understood, and agreed to the Product Conditions set by HOPS or the Partner Service Provider in full. Under (User Account), if you book or purchase a Product on behalf of or in the name of another person, we shall deem you to be the representative of the other person whose name appears on that Booking Confirmation. In this regard, you represent and warrant that you have been authorized by such other person, and that you cause that other person to be aware of and comply with these Terms. If you have not been authorized by another person, or do not notify or cause another person to be bound by and comply with these Terms, you alone shall be liable if that person fails to comply with these Terms. In addition, you shall notify such other person of various conditions regarding the booking (including the Product Conditions related to the booked Product) and cause that person to fully agree to and comply with the various conditions.
2.3 Your booking or purchase of a Product may not be confirmed immediately after you have successfully made payment. In such cases, the receipt of payment and/or the receipt that we send to you shall be the document showing that HOPS has received your booking or purchase request and the request is being processed. We will send you the Booking Confirmation within a reasonable time. You acknowledge and accept that the booking or purchase of certain types of Products may take longer than scheduled, due to the procurement process for the Products we offer on the Platform. You should regularly check the status of your booking or purchase to ensure that your booking or purchase has been confirmed by receipt of the Booking Confirmation. If you have not received the Booking Confirmation within a reasonable period, you can contact us first so that we can check the status of your booking or purchase, before you decide to book or purchase the same Product, a new Product, or a similar service to the one you have already booked or purchased. If you take such action, it may result in duplicate booking or purchase of Products ("Duplicate Bookings"). In such cases, HOPS shall not be liable to refund or compensate you for any damage if you make Duplicate Bookings. In addition, you acknowledge and agree that, when you receive the Booking Confirmation, the contract between you and the Partner Service Provider has been formed, and the Partner Service Provider has the duty to provide the various services regarding the Product directly to you or the persons specified in the Booking Confirmation.
2.4 You acknowledge and accept that we shall not be responsible and shall not have any liability for any damage you suffer arising from or related to acts or omissions of Partner Service Providers. In the event that the Partner Service Provider does not provide service in accordance with the Booking Confirmation, or the Partner Service Provider is dissolved, liquidated, in business rehabilitation, or under court receivership, or has insolvent debts or is bankrupt, or is in any similar process, or cannot provide service to you or the persons specified in the Booking Confirmation for any reason, you agree that you will pursue claims, demand compensation for damages or other monies, or take any other legal action against that Partner Service Provider directly.
2.5 You shall keep confidential the various details of your User Account, booking number, Booking Confirmation, booking code, or unique code generated in any form. HOPS and Partner Service Providers shall not be liable to you in cases where such booking number, Booking Confirmation, booking code, or unique code is lost, stolen, or destroyed. HOPS shall deem any booking or any subsequent action carried out through your User Account to be the booking and action of you or a person you have authorized. In addition, we have the right to refuse any request received from your User Account if we reasonably believe that you are not the one who submitted the request or order, or that your booking was carried out by a person other than you.
2.6 HOPS reserves the right to refuse or not act upon a request to book or purchase Products, or to cancel your Booking Confirmation, or to cancel your request to participate in any activity, in any case, including but not limited to the following examples:
2.6.1 The Product you booked or purchased is no longer available for sale or service by the Partner Service Provider.
2.6.2 A Manifest Error has occurred.
2.6.3 The Product is no longer offered on the Platform.
2.6.4 You do not pay for the Product you booked or purchased in full, or the Partner Service Provider or HOPS cannot collect payment for the Product from you by the due date, due to your fault, whether intentional or negligent.
2.6.5 HOPS cannot collect payment for the Product you booked or purchased, whether due to your failure to pay for the Product in full within the specified time, or because we cannot deduct or charge payment for the Product from your account, or from your credit card, debit card, electronic money or e-wallet, or by other payment methods, or because such payment cannot be processed due to errors arising from the bank system or payment service provider, whether on or off the Platform.
2.6.6 You provided inaccurate and/or erroneous information, or information that is misleading, when making the booking or purchasing the Product.
2.6.7 A force majeure event has occurred.
2.6.8 In case of technical problems on the Platform, including the display of incorrect prices and details of Products offered on the Platform that you know or should know are erroneous, or such errors are clearly evident, or the notification of erroneous prices and details can be seen and understood by reasonable persons that they are not the proper and commercially viable price or details of the Product, or are not Products that any Partner Service Provider could realistically provide, or
2.6.9 A breach, act, or any cause occurs (Suspension and Deletion or Closure of User Accounts).
If any of the above cases occurs, HOPS will be responsible only for communicating with the Partner Service Provider to offer other Products or services, or refund payment to you in cases where it can be done. However, in no event shall the offer or refund depend on the policy and discretion of the relevant Partner Service Provider.
2.7 HOPS may cooperate with other platforms operated or managed by third parties, by allowing such persons to offer various services on those other platforms, by directing users to our Platform (redirection). If you access services from another platform and book or purchase a Product, you must also comply with these Terms. You acknowledge that the terms and conditions of the other platform are an agreement separate from these Terms. If you wish to know which platforms we cooperate with, please contact our customer service.
2.8 HOPS shall not be responsible for transactions or communications between you and the Partner Service Provider (or any other person) that occur outside the Platform.
Special Requests
You may submit special requests when you book or purchase any Product on the Platform, or contact our customer service, or the Partner Service Provider directly, as the case may be. The Partner Service Provider will exercise discretion in considering your special requests, based on the availability of services and other factors in considering such special requests. You acknowledge that you may have to pay additional fees and/or service charges that the Partner Service Provider may add at its discretion and/or in accordance with that Partner Service Provider's policy. In addition, the Partner Service Provider may or may not act on your special requests, which may be due to availability of services or any other reason. HOPS shall not be liable to you in any way in cases where the Partner Service Provider does not have availability and/or is unable to act on your special requests.
Travel Advice and Documents
4.1 You alone have the duty to (1) study, acknowledge, and understand the various requirements and laws of the destination country you have chosen, the airline you have chosen to use, and/or stopover or transfer points; (2) decide on the choice of attractions, travel routes, country or destination of your choice, and the entire duration of travel; (3) consider and assess your own risks in traveling to your chosen country or destination, including preparing yourself and arranging various necessary documents to travel to your chosen country or destination (which may include but not be limited to terms and conditions regarding passports and visas, taking out travel insurance or other types of insurance, pre-travel health checks, and obtaining vaccinations for any epidemic diseases, medical certificates such as medical certificates indicating pregnancy, disability, or various diseases requiring a supporting medical certificate as specified in the conditions of carriage, and/or other travel documents required by the airline).
4.2 HOPS does not represent or warrant that travel to the country or destination presented on the Platform and/or that you have chosen to book or purchase on the Platform is a destination we recommend or one that will be safe from any risks and dangers. HOPS shall not be liable for injury, damage, or any losses that may occur to you from your travel to such country or destination. In no case shall HOPS be liable for any events that occur to you during your travel or stay.
4.3 HOPS has no duty to verify or notify you regarding travel requirements, details, procedures, preparations, and various documents of each country or as specified by other persons. Therefore, we shall not be responsible or liable to you or other persons in cases where you or any other person suffers injury, damage, or losses arising from your failure to prepare, or failure to obtain travel authorization, or failure to prepare various travel documents as required by each country in full, such as passports, travel authorization letters, visas, permits, or other documents. You alone have the duty and responsibility for damages or losses arising from non-action or non-compliance with the requirements of each country.
Promotions or Sales Promotions
5.1 We will organize campaigns, special programs, and special sales promotions from time to time, in order to reward and benefit Users on the Platform, including but not limited to special-priced Products, discount codes, coupons, promotional codes, special offers, and rewards. Such promotions may be offered by HOPS, Partner Service Providers, or partners or affiliates that co-organize promotions with us (the "Sponsors"). Some promotions may be available only in certain countries, and/or limited to Users in certain countries, and/or limited to a group of Users with qualifications specified specifically for each promotion, and/or limited to certain Products as specified by the Sponsor. Users may not be able to use or receive special privileges from one promotion together with other promotions available on the Platform, unless an exception is expressly specified. HOPS will notify the details, terms, and conditions of promotions, including the qualifications of Users who may receive special privileges from such promotions, the use, redemption of rewards, and other specific conditions on the Platform during the period in which such promotions are organized. You cannot use, exchange, or request a refund of promotions for cash, credit, travel vouchers, HOPS gift cards, or other Products. If you wish to receive or participate in a promotion, you must ensure that you are qualified and able to fully comply with the various terms and conditions of such promotion.
5.2 You acknowledge that the use of a promotion may not cover the entire price of the Product you book or purchase, and you remain obligated to pay the difference of the Product price after deducting the value of the promotion, in order to receive a Booking Confirmation or purchase, and to receive the service of that Product.
5.3 You may have a duty to pay tax based on the value of the promotion you receive. In this case, you agree to be solely responsible for paying tax and filing tax returns, or all related tax duties as required by law, and not to cause us to bear any tax burden from your receipt of various promotions. We will reasonably notify you in advance or at the time of using the promotion of the duty to pay tax arising from your use or receipt of a promotion from a Sponsor.
Cancellation, Modification, Refunds, and Additional Charges
6.1 If you wish to change or modify the details of your booking (including but not limited to purchase of additional services, changes of travel date or time, stay date or time, service date or time, route or destination, and/or details of passengers or guests) or to voluntarily cancel a Booking Confirmation, you may make modifications, changes, or cancellations through the features on our Platform, or contact HOPS' customer service. You agree that:
(1) Whether modifications, requests for change of service date, cancellations, or refunds can be made depends on the Product Conditions as specified by the Partner Service Provider and HOPS (as applicable); and (2) you may have to pay additional service charges, fees, or expenses for such modifications, change of service date, cancellation, or refund. HOPS will facilitate and communicate with the Partner Service Provider regarding your request to modify, request for change of service date, cancellation request, or refund request. You acknowledge that the result of consideration of such request will be in accordance with what the Partner Service Provider considers and notifies us. You acknowledge that you may have to pay additional service charges, fees, or expenses to the Partner Service Provider for the Partner Service Provider to act on your request, and you must pay such additional service charges, fees, or expenses on our Platform through the payment channels on the Platform. In addition, HOPS reserves the right to charge additional service charges or other expenses to facilitate and process your request, separate from and in addition to the service charges, fees, or other expenses charged by the Partner Service Provider. You acknowledge that special requests, modification requests, and/or some additional services may not be refundable in accordance with the terms and conditions of that Partner Service Provider.
6.2 In cases where the Partner Service Provider modifies, postpones the travel date or time, stay date or time, service date or time, or cancels the booking, if you so request, HOPS will communicate with the Partner Service Provider to request a refund or to request a change of service date (as applicable) for you. Such refund request will depend on the approval and terms and conditions of the Partner Service Provider. HOPS does not warrant that the Partner Service Provider will refund you in full or in part, or agree to approve a change of booking or change of service date for you, or will respond to and act on your request within a reasonable timeframe.
6.3 If you wish to modify various details after receiving the Booking Confirmation, HOPS recommends that you submit a request to postpone or modify the travel schedule, stay date or time, or service schedule through the channels available on the Platform, in order to prevent inconsistencies between the information HOPS has received and the information the Partner Service Provider has received. If you request a postponement of the travel schedule, or modification (including but not limited to changes of travel date and time, stay date and time, or service date and time, route or destination, and/or details of passengers, flight class, or upgrade of room, addition or purchase of additional services) directly with the Partner Service Provider, HOPS will not be responsible for any aspect of your request to postpone or modify the travel schedule, stay date or time, or service schedule that occurs in respect of your original booking or purchase that occurred on the Platform, and in this case:
6.3.1 HOPS has no duty to send or notify any modifications regarding your booking on the Platform, or to alert you of new travel schedules, modifications, or any changes through any communication channels you have specified, and
6.3.2 HOPS shall not be responsible or liable for damages, claims, or any legal consequences arising from new travel schedules, modifications, or changes to your booking that you arrange directly with the Partner Service Provider.
6.4 HOPS will process refunds to you, processing refunds through the same channel you used to pay for the Product under the Booking Confirmation, both for refunds at your voluntary request and for involuntary refunds where you have not made a refund request but we process a refund pursuant to the policy or service cancellation of the Partner Service Provider. In cases where we cannot process a refund to you through the same channel you used to pay for the Product, or in cases where you paid for the Product by transferring to our bank account, or paid through other offline payment channels, such as payment over the counter, or other payees, we will refund you by transferring the refund to a bank account that you have correctly and completely provided on the Platform at the time you submit a refund request, or that we must use to refund you (the "Designated Bank Account"), unless the payment service provider specifies an alternative method. HOPS reserves the right to suspend and refuse the transfer of refund to the bank account you have notified us of, if we consider and find that your refund request is a transaction that gives rise to reasonable suspicion, contravenes, or may contravene laws on money laundering, financing of terrorism, fraud, or other criminal offences, or may relate to unlawful conduct. In such cases, HOPS may report such transactions or behavior to relevant authorities (in cases where we have a duty to report under the law) to comply with applicable laws. You alone shall be responsible for the various details you have notified us of, and we shall not be responsible for the accuracy or completeness of the information you have provided. To the extent permitted by applicable laws and regulations, if (1) we cannot refund you through the same payment channel you used to pay for the Product under the Booking Confirmation, for any reason caused by the bank, payment service provider, HOPS, or you; or (2) you do not provide the various details necessary for the refund, do not add the Designated Account on the Platform, the details of the Designated Account you added on the Platform are incorrect, or no such account exists in the bank's system; and (3) we cannot contact you or you do not respond to us after we have made efforts to contact you regarding the refund through the email or telephone number you registered, we may stop the various processes for refunding you.
6.5 HOPS has the right to set off, or deduct expenses or various service charges (including various fees, payment channel service fees, credit card network fees, bank fees, and other service charges) arising from refunds in accordance with your refund request, from the refund amount you will receive, in order to pay for the various expenses or service charges arising from your Booking Confirmation cancellation request. HOPS will notify you in cases where we deduct service charges or various expenses (if any) after you have submitted a refund request or after we have refunded payment to your account.
6.6 In some cases, the Partner Service Provider may offer you a refund in another form, or travel credits instead of cash refund or transfer of refund to your account. We will notify such offers in accordance with the policy and/or recommendation of the Partner Service Provider for your information. You acknowledge that HOPS has no authority to make decisions or considerations regarding the policies or recommendations of the service provider. If you are not satisfied with such offer, you agree to file complaints or take legal action solely against the Partner Service Provider.
6.7 HOPS may offer to refund you in the form of HOPS coupons and/or HOPS points, gift cards, and/or discount codes for your booking that the Partner Service Provider has cancelled. In cases where you accept the alternative offer instead of a refund from us, you acknowledge and agree that your right to receive a refund in the form of cash or transfer to your account terminates, and HOPS no longer has any duty to refund cash or transfer payment to your account.
6. You have the duty to cooperate and provide various information as necessary to HOPS so that we can process refunds to you within the specified time. If you neglect to cooperate or fail to promptly provide us with various information that is necessary, or are slow to cooperate or to provide information, HOPS shall not be responsible or have any liability to you for not receiving a refund or receiving a refund late.
6.8 You cannot request a refund for payment for Products using promotions, in whole or in part, unless HOPS expressly specifies otherwise in the specific terms and conditions of that promotion.
6.9 In cases where you have not received the Booking Confirmation or we have not confirmed your booking after you have made payment, we may cancel the booking and refund you. We will refund you through the same channel you used to make payment, or transfer the refund through the Designated Bank Account.
User Account
7.1 You will receive a good experience using the service, receive convenience, and gain full access to all features available on the Platform. You can book or purchase any Product on the Platform by creating a User Account or logging in to your User Account on the Platform. When you register a User Account and throughout the period that you continue to use your User Account, you agree to provide truthful, current, accurate, and complete information. Please read and understand HOPS' Privacy Notice regarding the way we conduct the collection and processing of your personal data for the purpose of registering a User Account in accordance with our Know-Your-Customer (KYC) policy. However, HOPS has sole discretion to refuse the registration of your User Account, as applicable law permits us to take such action. We therefore recommend that you enable all communication channels (including email, telephone number, including communication channels linked to your email and telephone number, alert messages, and messages in the My Inbox) to ensure that you receive important messages regarding the use of your account. We shall have no liability if you do not receive or do not read messages or various communications that we send to you.
7.2 You may not transfer the right to use or transfer your User Account to other persons. You alone may use your User Account, and you represent and warrant that you will not allow any other person to use your information, username, password, email, or telephone number, or to use your User Account, for any reason.
7.3 You must maintain the security and confidentiality of your username (USER), password, email, telephone number, or other codes related to your User Account, and you must keep your User Account under your control, and use appropriate measures to prevent unauthorized access to your account, including setting a strong password and using features to keep your account secure.
7.4 We recommend that you immediately report to us if you find that any person has used or accessed your User Account (USER) without authorization, or that the security of your User Account has been compromised. When we receive reports of unauthorized account use or other similar matters, we will examine the information and details of that matter, in order to verify the truth of the report. This may include examining activities and transactions through the User Account, verifying the security breach of the User Account, and assessing whether the unauthorized access to the User Account occurred due to any error of our own.
7.5 If the security breach of the User Account did not arise from our error or from the security measures of our system, technology, Platform, and Services, HOPS shall not be liable for damages arising from access to your User Account (USER) by another person using your personal information to log into the system, your failure to use sufficient security measures, or the actions of other persons beyond our control.
7.6 You acknowledge that telecommunications service providers may make email and/or telephone numbers that you have ceased to use available for use by other persons later. HOPS shall have no liability to you if other persons use your former email or telephone number to log into your account. Therefore, if you cease using, cancel, or have your email or telephone number cancelled, or change your email or telephone number, you must immediately update such details to be current in your User Account. If you become aware that your former email or telephone number has a new user, and is being used with an account that is not yours, you must notify us promptly so that we can take reasonable corrective or preventive action regarding the damage.
Suspension and Deletion or Closure of User Accounts
8.1 HOPS will protect your User Account (USER) from unauthorized access, data breaches, and other threats. If we find or have reasonable suspicion that your account has been breached, your data has been leaked, or there has been a security breach affecting User data, we reserve the right to use reasonable measures to maintain the security of your account or your personal data. Such measures include but are not limited to resetting passwords, suspending or temporarily stopping access to the User Account, restricting activities that can be carried out through the User Account, or possibly adding more rigorous identity verification steps to ensure that the User is the one controlling and using the account.
8.2 HOPS has discretion to take action under Clause 8.1 without giving you advance notice, in cases where we need to prevent damage or security breaches, and/or if we find or reasonably believe that:
8.2.1 You do not comply with or breach these Terms.
8.2.2 You do not comply with the Product Conditions.
8.2.3 You violate applicable law.
8.2.4 You misuse the Platform or our various services, or commit fraud or any improper act, with the purpose of or for the purpose of seeking benefits other than using or carrying out the various transactions that can be carried out on the Platform and receiving services from us.
8.2.5 You commit any act that is unlawful or contrary to morality or good ethics, whether the act is taken to obtain direct benefits arising from problems or errors of the system (bugs), or from the installation of third-party plug-ins, or carrying out actions in any manner that does not constitute
8.2.6 Compliance with or proper operation under the Product Conditions.
8.2.7 You commit or are involved in acts or omissions that constitute criminal offences or violations of law.
8.2.8 You exhibit inappropriate behavior, or you threaten, behave rudely, or post or publish inappropriate content, or refuse to cooperate with us regarding the use of the Platform, Products, and various services, or
8.2.9 You are on a list of persons designated under government or international organization "blacklists" or "watchlists", or are subject to trade or economic sanctions from international organizations.
8.3 HOPS may, at its sole discretion, immediately delete or close your User Account, and permanently prohibit you from using our Platform and Services, if we consider that your conduct in any of the following cases may affect our service provision, the operation of the Platform, the Products of Partner Service Providers, or our reputation or business operations, as follows:
8.3.1 You commit or omit to commit any act that is improper, fails to comply with, or breaches the Terms (Suspension and Deletion or Closure of User Accounts) in a material respect.
8.3.2 You do not take action to remedy your breach of the Terms or non-compliance with these Terms, or do not take various actions in accordance with the recommendations or requests we have notified you of during the time we are conducting examination of the events that occurred while we suspended service to you temporarily, or
8.3.3 We have previously suspended service or refused to allow you to access your User Account temporarily, and you continue to commit acts or omissions, or continue to exhibit various behaviors as specified, whether by acts or omissions, or behaviors that violate in the same manner and/or similarly again, or by violating other prohibitions, or we cannot collect payment from you multiple times, due to your fault, whether intentional or negligent.
8.4 The above suspension, refusal of access to your User Account, deletion or closure of your User Account does not affect any Booking Confirmations that you booked or purchased before we took the above-mentioned actions. You can still access the Booking Confirmation, including communications in your account that occurred before the suspension, refusal of access to your User Account, deletion or closure of the User Account. You acknowledge that the suspension, refusal of access to your User Account, deletion or closure of the User Account may affect various details related to your User Account.
8.5 During the temporary stoppage of service or refusal to allow you to access your User Account, or after your User Account has been deleted or closed, you shall not create another User Account and shall not carry out any transactions on the Platform. If we detect or suspect that you are attempting such action, or find any bookings under your name or contact information, we reserve the right to cancel any Booking Confirmations you book or purchase during the time we suspend service or after your account has been deleted or closed, and to forfeit all refunds that the Partner Service Provider may return to you due to the cancellation of the booking, and you shall be fully responsible for damages we incur due to such matters.
Payment
9.1 You must pay for the Products you book or purchase, and the various fees or service charges specified on the Platform, by transferring or depositing into the bank account specified by HOPS, or paying through the payment channels on the Platform or as we have notified you, or other alternative payment methods available on the Platform, in the currency displayed on the Platform. You must ensure that you pay the correct amount (which includes decimal places, or specific unique number identifiers as we have notified you in full, without rounding up or down) in accordance with our guidance and instructions. Your booking or purchase of a Product will not be complete and will not be confirmed if you do not pay the correct full amount through the payment channels available in accordance with our guidance and instructions. HOPS shall not be responsible for any booking or purchase of Products, or any transactions, that are unsuccessful or are pending due to your payment being incorrect, complete, late, or our being unable to confirm that your payment is complete and accurate because you did not act in accordance with the guidance and instructions for paying for Products.
9.2 To the extent the law permits us to do so, we may charge you additional fees or service charges in addition to the payment for Products or other transactions as specified in (Payment), which include bank and credit card fees, service charges for payment by credit card or debit card, service charges relating to or arising from international money transfers, and other types of fees and service charges. The transactions and various service charges shall be subject to Clause 10 (Tax). To the extent permitted by applicable laws and regulations, you may not request a refund of taxes, and such fees or service charges, from HOPS.
9.3 You must pay for Products and various services within the prescribed period. If you do not pay within the prescribed period, HOPS will automatically cancel your booking or purchase of the Product.
9.4 In cases where there is an error regarding your payment or booking that is not the fault of HOPS, you must immediately notify HOPS' customer service or submit a request through the features on the Platform to obtain assistance. We may request various information about you, your booking, and proof of payment in order to verify the payment and notify you about the issue, including notifying you of the actions you must take to resolve the unconfirmed booking issue. After we conduct the above examination and agree to refund what you have paid incorrectly or incompletely, HOPS will process the refund to you in accordance with the methods, procedures, and timeframe specified (Cancellation, Modification, Refunds, and Additional Charges). HOPS has the right to set off, or deduct expenses or various service charges (including various fees arising from the use or use of services of credit card networks, bank fees, and other service charges) from the refund amount you will receive, which are expenses or service charges arising from refunding you. HOPS shall not be responsible for any damages that you or other persons receive as a result of delays or non-fulfillment of the obligations mentioned above, and you agree not to make any claim against us.
9.5 If you pay by credit card, debit card, or virtual credit card on the Platform, you represent that you understand, comply with, and are bound by the terms and conditions set by your bank or card issuer, and the regulations of the credit card networks, including various rules regarding fraud, chargebacks, refusal of payment, and the procedures you must follow if there is fraud or unauthorized use of your card. You alone shall be responsible for any losses or damages arising from fraud or unauthorized use of your card by other persons. HOPS shall not be liable or responsible for damages arising from the cases mentioned above.
9.6 In some cases, we may ask you to submit additional identification information or evidence for verification and confirmation of your booking, which we will clearly notify you of on the Platform or through the communication channels you have provided to us. Your booking or purchase of Products will not yet be confirmed until you receive a confirmation email together with the Booking Confirmation (including an electronic ticket (e-ticket)) from us. In some cases, certain Partner Service Providers may require you to provide additional information so that the Partner Service Provider can conduct an examination of you under their Know-Your-Customer (KYC) policy and anti-fraud policy. If the Partner Service Provider examines and finds that you are a prohibited person or that fraud may have occurred, your booking will be void and cancelled. HOPS shall not be responsible in any way in cases where the Partner Service Provider cancels such booking, and if you do not submit additional information as requested by the Partner Service Provider, we will automatically cancel your booking.
9.7 HOPS may or will collect payment for Products on behalf of and in the name of the Partner Service Provider. You acknowledge that HOPS is not a party to the contract between you and the Partner Service Provider in any way.
Tax
10.1 HOPS is only an intermediary service provider that connects you with various Partner Service Providers under these Terms. HOPS is not a legal representative of Partner Service Providers for any purpose. Nothing in these Terms shall be interpreted as HOPS being a principal, a Product service provider, or a seller or reseller of the Products of Partner Service Providers to you, unless HOPS expressly notifies you that we are the provider of that Product ourselves.
10.2 Any service charges that HOPS collects from you, including but not limited to service charges that we collect from you under Clause 9 (Payment), are service charges that include goods and services tax, value added tax, sales tax, service tax, consumption tax, government remittances, withholding tax, taxes on digital or electronic transactions, or any other similar tax (Transaction Tax) that we are required to collect from you and remit to relevant government agencies.
10.3 You shall be responsible for taxes, fees, surcharges, additional payments, duties, and tax assessments arising from your use of the Platform. In the event that new laws come into force, or government authorities collect additional taxes, or transaction tax rates increase from booking or purchasing Products, you agree to be responsible for and pay tax in accordance with the new law or at the increased rate collected by the government authority, unless prohibited by law.
10.4 In cases where HOPS is an independent service provider, taxes and fees displayed on the Platform shall be deemed to be amounts that the Partner Service Provider collects from you. HOPS is not the one setting the tax rate or the tax amount to be collected from you. We will pay all taxes and various fees to the Partner Service Provider on behalf of and in the name of you, and HOPS does not directly remit taxes and fees to government authorities, unless expressly prescribed by law. In cases where the taxes and fees that HOPS collects from you are merely an estimate of the tax amount, and the amount we pay to the Partner Service Provider is not equal to what we collected from you, you acknowledge that the difference of such money is a service charge arising from your booking that HOPS has the right to retain.
10.5 The Partner Service Provider has a duty to issue a tax invoice to you in accordance with applicable law, unless the law specifies otherwise.
11. Rights in User Content
11.1 When you have completed booking or purchasing a Product, carrying out other transactions, and/or receiving service from a Partner Service Provider, you may receive an email from HOPS to survey satisfaction, invite you to express opinions, or provide opinions about content on the Platform, the use of the Platform, or services on the Platform, the selection and presentation of Partner Service Providers, and your experience using the services of Partner Service Providers. You may express opinions about such matters at any time at your convenience, and you can choose to participate or not participate in such opinion expression. At any time, you can manage and choose to receive or not receive invitations to express opinions on the Platform.
HOPS has sole discretion in deciding whether to publish your comments on the Platform or not, and in some cases, may need to amend your comments to make them clear, easy to understand, and lawful. We shall not be responsible or liable to you in any way for the modifications of your comments or messages. HOPS will screen, conduct a preliminary examination, and review the messages and content of your comments, and assign our employees or staff to review the content using the standards under Clause 11.2 (Rights in User Content) to prevent the content of your comments from containing inappropriate or unlawful messages displayed or published on the Platform. HOPS may publish and display your comments, and the messages or content that we have modified from your original comments or messages, including various reviews, service experiences, and your name on the Platform.
11.2 You agree that you alone shall be responsible for the messages or content of your comments, photographs, videos, or other types of media that you publish, upload, or submit on the Platform, including comments under Clause 11.1 (Rights in User Content) (if any), content you create on HOPS' features. When publishing content on the Platform, you represent that:
11.2.1 You are the owner of the content and have full rights to the content you publish or post on the Platform.
11.2.2 You permit us to use your comments, including various intellectual property rights regarding such comments, in conducting our business, including operating and managing the Platform. You grant such permission in a permanent, irrevocable, royalty-free, worldwide manner, and allow us to permit other persons to use your rights or content.
11.2.3 The information in the content is accurate and not misleading.
11.2.4 Your content uses neutral language and does not convey obscenity, contempt, defamation, is not political opinion, is not racist or discriminatory based on skin color, is not contrary to good morals, does not violate the personal data or privacy of others, or unlawful, or messages or content that support violence, terrorism, or messages relating to sexual services or premises, adult entertainment establishments, tobacco products, drugs, or illegal narcotics, medical devices or medical equipment for treating sexual diseases, mental health, or terminal illnesses, dating platforms or applications, or messages or content related to discrimination based on race, gender, religion, or beliefs.
11.2.5 The use, operation, or submission of your content is not an act that breaches these Terms, or laws or regulations, and you do not infringe the rights of third parties, and do not cause damage to other persons; and
11.2.6 You have read and agreed to be bound by and comply with the Community Guidelines here when you use the features on HOPS' Platform.
11.3 HOPS shall deem the various content you provide to us not to be confidential information, and HOPS has no duty to treat any of your content as confidential information. If your content contains material related to the personal data of other persons, you must obtain consent from the owner of such personal data before publishing such content to HOPS. HOPS has sole discretion to use the various content as we see fit, including but not limited to deletion, removal, modification, or amendment of the messages or content of your content. Such actions of ours do not change your duties under these Terms; you must continue to comply with these Terms in all respects. HOPS will not pay any compensation to you for content you submit to us for display on the Platform, including content of yours that we modify, delete, or remove and have displayed on the Platform.
11.4 In any case, you agree that:
11.4.1 You do not require us to display the name of, refer to, or identify the owner of the content or any derivative works.
11.4.2 You consent to HOPS, and the employees or successors of HOPS, or any transferees from HOPS, by any means, using your content that you submit to us, including but not limited to commercial use, publication, reproduction, or modification of the content.
11.4.3 You waive all rights and agree not to claim any rights regarding any content, including but not limited to moral rights and commercial rights.
11.5 If a dispute arises, or any person makes a claim or sues HOPS regarding content you publish on the Platform, or you fail to comply with Clause 12 (Rights in User Content), you must be liable for the damages caused to HOPS, including compensation for damages or compensation paid to third parties, costs of legal proceedings incurred, and other costs that may be incurred.
12. Intellectual Property Rights
12.1 HOPS owns all intellectual property rights regarding various content on the Platform, including but not limited to copyrights, patents, domain names, trademarks, service marks, logos, symbols, or other designs, software, text, data, graphics, images, sounds, videos, trademarks, logos, symbols, homepage codes (HTML code), and other codes on the Platform, etc. (the "Intellectual Property Rights"). HOPS does not grant you, or allow you to use any rights, whether expressly or impliedly, to copy, reproduce, use, possess, sell, or alter any Intellectual Property Rights. We do not allow you to publish, modify, reproduce, copy, alter, or use in any way the Intellectual Property Rights without written permission from HOPS. If you infringe Intellectual Property Rights, HOPS reserves the right to take any legal action against you, including civil, criminal, and/or administrative proceedings or prosecution, to claim damages or other money from you in full.
12.2 You agree not to use the Platform or HOPS content, whether directly or indirectly, for commercial purposes, or for purposes other than personal use (unless you have entered into a contract for distribution and/or for marketing purposes with HOPS), or for unlawful purposes, or in violation of these Terms. You agree not to modify, copy, distribute, transmit, display, exhibit, reproduce, publish, license, or cause the imitation, transfer, sale, or purchase and resale of any data, software, products, or services that you receive from the Platform.
13. Your Representations and Warranties
When you access the Platform, book or purchase a Product, or use our services, you represent and warrant that:
13.1 You are a person of at least the minimum age we set, and have full legal capacity to book or purchase Products or carry out transactions on the Platform, and you can perform your obligations regarding the relevant transactions.
13.2 You are not a person on a "blacklist" or "watchlist" of governments or various international organizations, or subject to penalties under laws on prevention and suppression of money laundering and counter-terrorism financing.
13.3 You have not violated laws on prevention and suppression of money laundering and counter-terrorism financing, and you will not access the Platform or use services or products for any acts that violate laws on prevention and suppression of money laundering and counter-terrorism financing.
13.4 You are the owner of the payment channel you use on the Platform to book or purchase Products or use our services, or you are authorized to book or purchase Products or use various services on the Platform, and you have sufficient funds for such payment.
13.5 Any information you provide on the Platform for the purposes of registering a User Account, booking or purchasing Products, or using services, or participating in promotions, is true, accurate, and complete, and such information is in accordance with the requirements of us, the service provider, and/or the Sponsor.
13.6 Your use of the Platform does not infringe any rights of third parties.
13.7 You will inform other persons about the terms and conditions applicable to bookings or the Product Conditions of Products you book and/or purchase on behalf of or in the name of others, including all related conditions and limitations.
14. Reasonable Efforts
We will take various actions to make our Platform and Services usable efficiently. However, in some cases, HOPS may need to stop or temporarily suspend service or the Platform, in whole or in part, for various purposes that we see fit, including but not limited to repairs, maintenance, or development of various systems. You acknowledge that during each stoppage or suspension of service, you may experience problems accessing the Platform, and may not receive convenience or be unable to use our service.
15. Limitation of Liability
15.1 You represent and agree that, to the extent the law permits us to limit liability:
15.1.1 The provision of the Platform, Products, our Services, and HOPS content is provided on the basis of "as is" and "as available". HOPS does not represent or warrant, whether expressly or impliedly, regarding the quality of our products and services, the suitability and availability of our products or services offered on the Platform, and that the offering does not infringe the rights of any persons.
15.1.2 We do not warrant that (1) various functions on the Platform, our services, and various features on the Platform will be able to operate without interruption during use, or without any errors; (2) we will quickly correct errors or failures of use; or (3) the Platform or systems related to service provision will be free of viruses, malware, or various harmful components.
15.1.3 We do not warrant the accuracy, correctness, completeness, or quality of content, the Platform or various services available on the Platform, including but not limited to warranting that content, the Platform, or services are free from any harmful sources of information, that are inappropriate, or that cause conflicts with one another.
15.1.4 We do not represent or warrant that you will receive various permits for travel that you must obtain before traveling. We are not responsible for notifying you, or compensating you in cases where you receive any damage or losses arising from your failure to obtain a visa or permit for travel (including but not limited to cases where you are denied permission to travel, denied boarding of an aircraft or other vehicle, denied entry to the destination country, or deported).
15.1.5 Any media you download or otherwise obtain through the Platform is your sole responsibility and risk. You voluntarily accept such risk, and you shall be responsible for damages or losses incurred or related to such media, including but not limited to damages caused to your computer system or your loss of any data caused by downloading various media on the Platform.
15.2 Principally, liability related to the use of Products or provision of Product services (including but not limited to refunds and compensation) shall remain with the relevant Partner Service Provider. In special cases where the law requires us to compensate you (in our name or in the name of the Partner Service Provider), you accept that our liability shall not exceed the amount you actually paid for the relevant Product.
16. Indemnification
You agree to indemnify and defend HOPS, Partner Service Providers, Sponsors, employees, affiliates, staff, and various partners of HOPS, regarding allegations, claims, responsibilities, damages, or losses, including legal fees incurred as a result of claims or lawsuits by third parties (the "Third-Party Claims") related to:
16.1 Your access to, use of, or transactions on the Platform.
16.2 Your use of our services.
16.3 You infringing or improperly acquiring third-party rights, including infringement of intellectual property rights and any other rights of others.
16.4 Your failure to comply with these Terms, or violation of various rights or duties under the law.
16.5 Your action or omission in any way, whether negligent, unlawful, or otherwise.
HOPS has sole discretion in deciding whether to participate in any claims, proceedings, negotiations, or dispute resolutions arising from or related to Third-Party Claims. You shall not enter into any settlement or take any action that may significantly adversely affect our rights and duties, unless we expressly approve or consent. In addition, we reserve the right to defend Third-Party Claims ourselves, at our sole expense.

The Privacy Notice is part of these Terms. Please review and study the Privacy Notice here to understand the processing of your personal data.
18. Governing Law
Unless otherwise specified, these Terms (and any disputes or all disputes arising from or related to these Terms (including but not limited to allegations of breach of the Terms, or in cases of disputes regarding the validity and applicability of these Terms)) shall be governed by and interpreted in accordance with the laws of Thailand.
19. Country-Specific Provisions for Each Country in Which You Use Services
Thailand
19.1 Suspension and Deletion or Closure of User Accounts
19.1.1 In cases where we exercise discretion to suspend service or temporarily restrict your account use, or not allow you to purchase or book Products or carry out transactions on the Platform, in accordance with the clause (Suspension and Deletion or Closure of User Accounts), HOPS will notify you in writing through the Platform, email, or your telephone number, before or while suspending service to you temporarily, with reasons for the action, including in cases where you do not comply with these Terms. You may contact us through the channels specified within 7 (seven) business days after you have received such notification, and may notify us further about the facts of such events, and/or take action to remedy the breach of the Terms, improve behavior, or comply with these Terms in full and accurately. Travelloka will examine the events that occurred carefully, or may request you to provide additional facts and information about various matters. After that, we will contact you back to notify you of recommendations, examination results, and/or cancellation of the suspension of service, within the prescribed period.
19.1.2 After we cancel the temporary suspension of service or restriction of your account use, you will be able to use your User Account, use services and carry out transactions on our Platform within 7 (seven) business days.
19.1.3 In cases where we exercise discretion to delete or close your User Account in accordance with the clause (Suspension and Deletion or Closure of User Accounts), HOPS will notify you in writing through the Platform, email, or your telephone number, before or while deleting or closing your account, with reasons for the action, including in cases where you do not comply with these Terms. You may contact us through the channels specified within 7 (seven) business days after you have received such notification, and may notify us further about the facts of such events, and/or take action to remedy the breach of the Terms, improve behavior, or comply with these Terms in full and accurately. Travelloka will examine the events that occurred carefully, or may request you to provide additional facts and information about various matters. After that, we will contact you back to notify you of recommendations, examination results, and/or cancellation of the deletion or closure of your account, within the prescribed period.
19.1.4 After we cancel the deletion or closure of your User Account, you will be able to use your User Account, use services, and carry out transactions on our Platform within 7 (seven) business days.
19.2 Reasonable Efforts
If a case under (Reasonable Efforts) occurs, we will use reasonable efforts to notify you of the temporary stoppage or suspension of use of the Platform or services, as follows:
19.2.1 If it is a case of advance preparation, we will notify you in advance of the date and time at which we are preparing to temporarily stop or suspend the Platform and services, which may affect the various services to you, including the duration and reasons for each temporary stoppage or suspension of the Platform and services; and
19.2.2 If it is a case that is not pre-planned, an urgent case, or other case, we will promptly notify you of the necessity for us to temporarily stop or suspend the Platform and services, including details and reasons for each temporary stoppage or suspension of the Platform and services.
19.3 Complaint Handling and Dispute Resolution
19.3.1 If you have a complaint, request, are affected by the use of our services or services by service providers, need assistance from us, or wish to contact us regarding any other matter under these Terms or related to the Platform and/or our services ("Issue"), you can contact us through the following communication channels:

19.3.2 When we receive notice of an Issue, we will take the following actions:
We will provide a reference number for the Issue and coordinate with relevant internal departments to follow up on your Issue.
The relevant internal department will examine the facts and supporting evidence of the Issue, and/or contact the service provider in cases where the Issue relates to services operated by the service provider.
After we complete the internal examination, and/or receive a response from the service provider, we will contact you back as soon as possible through the communication channel by which you contacted us.
Generally, we will respond to you within 24 (twenty-four) hours from the time you first contacted us. You acknowledge that our response or recommendations within the above timeframe may be only preliminary information for resolving the Issue. We may take longer to assist you, depending on the time the service provider and/or HOPS (as applicable) needs to take action to consider and resolve the Issue. However, in any case, we will use our best efforts to manage and resolve your Issue within 90 (ninety) days from the date you first contacted us.
In cases where we cannot resolve the Issue for you, or in cases where a dispute arises from or relates to these Terms, you agree to resolve the dispute under Clause 20 (Dispute Resolution).
20. Dispute Resolution
In cases where there are disputes or controversies arising from or relating to these Terms, both parties agree to resolve such dispute or controversy by amicable consultation within 60 (sixty) calendar days from the date one party receives a notice of dispute or controversy from the other party. If both parties cannot agree to resolve the dispute or controversy within the above period, either party may file a lawsuit or claim to resolve the dispute with a court of competent jurisdiction in the country.
21. Force Majeure
21.1 HOPS shall not be responsible for any damages or losses to any persons arising from force majeure. 21.2 HOPS shall not be responsible in any way for non-compliance with or violation of these Terms, such as failure of transactions, restriction of access to the Platform, or any damages or harm caused to Users arising from acts or any conditions beyond reasonable control, whether of yours or ours ("Force Majeure"). Force Majeure includes but is not limited to natural disasters (floods, earthquakes), epidemic diseases, pandemic diseases, dangerous diseases that cause restrictions on travel, riots, declarations of war, war, military actions, terrorism, embargoes, trade sanctions or boycotts, changes of laws or regulations, lightning, hurricanes/typhoons/cyclones, labor strikes, protests, bankruptcy or illiquidity of Partner Service Providers, and cyberattacks.
22. Additional Specific Conditions for Particular Products and Services
In addition to these Terms, certain Products offered on the Platform may be subject to specific terms and conditions under this Clause 22 (Additional Specific Conditions for Particular Products and Services), which you must read, understand, and accept before booking or purchasing such Product on the Platform. If the conditions specified in this Clause 23 contain wording that conflicts with other conditions in these Terms, the conditions in Clause 23 shall prevail. In addition, you must be bound by and comply with the Product Conditions of the Products you book or purchase. You will be able to read and understand the Product Conditions at the time you book or purchase the Product.
22.1 Flights
22.1.1 You agree to be bound by the conditions of the various airlines that issue air tickets to you in accordance with the Booking Confirmation. You acknowledge that such conditions may include restrictions related to payment, cancellation, postponement of travel, change, refund, and other ticket conditions. Some airlines may prohibit booking of "point-beyond", "hidden-city", or "back-to-back" tickets, and round-trip tickets where you do not intend to use service for one of the legs, use each leg of the air ticket out of the booking sequence, or use only some flights. In any of the cases mentioned above, your ticket will be automatically cancelled in accordance with the airline's policy (including check-in but failure to present yourself for travel (no-show) or failure to cancel the ticket within the prescribed time before travel, etc.). If your ticket is cancelled due to the reasons mentioned above, you may not receive a refund, in whole or in part, from the airline and/or HOPS for air tickets you did not use to travel. In addition, if you wish to use the return air ticket, the airline may charge an additional no-show fee or other types of additional fees.
22.1.2 If you decide to book multiple one-way tickets instead of round-trip booking, you must book each one-way ticket and make payment separately on the Platform. Each booking may be subject to different terms and conditions set by the airline. The management and use of each air ticket will not affect the other tickets.
22.1.3 We will notify you on the Platform while you are searching for air tickets in cases where the airline has a code-share agreement with another airline, or the airline does not provide service on the route you have selected, or there is no flight class or ticket type on that route, but there is a service agreement on the route, flight class, or ticket type with another airline. For example, you may purchase an air ticket from one airline that issues the ticket and travel with another airline that operates that flight, or you may purchase an air ticket with a particular flight class or ticket type for traveling along the entire route to the destination, but the airline that has an agreement with the airline you purchased from, or any particular flight, does not have the same flight class or ticket type for every travel leg or every flight purchased. That is, on some flights or with some airlines, the cancellation or refund policy may differ from what you purchased, or that flight may not have a premium flight class, etc. If you choose to purchase such a flight type, we shall deem that you accept the services of the issuing airline and the airline operating the flight that you chose in full.
22.1.4 In some cases, your travel may consist of travel by aircraft and other transportation (such as bus or train) provided by other persons, in order to connect to the route or destination you wish to travel to. You acknowledge that other persons are the providers of these various services, and the schedules, various policies, agreements, and conditions of those service providers may change from time to time, at the discretion of each service provider. You agree to be solely responsible for verifying and complying with the various policies of those transportation service providers.
22.1.5 You acknowledge that you may receive air tickets with multiple Passenger Name Records (PNRs), even though you make one air ticket booking and have only one HOPS booking number. You agree to be solely responsible for verifying and understanding the policies or conditions of the air tickets you receive before completing the booking and payment.
22.1.6 You acknowledge and agree that the airline may change the flight schedule or cancel the flight in accordance with the conditions set by the airline, under the clause (Cancellation, Modification, Refunds, and Additional Charges). We will provide assistance in communicating issues, requests, or complaints with the relevant airline based on your booking code and PNR, and acknowledge that the airline has sole discretion in deciding matters that we carry out on your behalf and forward to the airline. HOPS shall not be responsible or liable to you in any matter that the airline has not assigned or authorized HOPS to take action on, and you must verify and understand the various policies and conditions related to the air tickets you have purchased, including the airline's refund or flight change policy. 22.1.7 The price of the air ticket you purchase on the Platform includes airport tax, other taxes, and fees that the airline or government authority collects (if any). You acknowledge and agree that you cannot request a refund of taxes and various fees, unless laws, regulations, or rules set by the government authority or airline specify otherwise.
22.1.8 We will use reasonable efforts to offer additional or other services that the airline provides, and/or to offer flight classes and air ticket types of various airlines for variety, at the time you purchase an air ticket on the Platform or after you have received the Booking Confirmation and air ticket. HOPS may charge additional service charges or fees for additional or supplementary services that we offer on the Platform. We will notify you of such additional service charges or fees at the time you make payment for the booking or purchase of additional or supplementary services.
22.1.9 If you (1) do not travel on any leg or all legs in accordance with the Booking Confirmation and air ticket, (2) cannot reach the boarding gate within the prescribed time, and (3) the airline or HOPS has not cancelled the flight or air ticket, and you have not requested a flight change, your Booking Confirmation and air ticket will be a ticket called "No-Show", and you will be subject to and must comply with the policy and measures regarding No-Show.
22.1.10 When you purchase and confirm an air ticket booking on the Platform, you authorize us to file a refund request and collect refunds, in cases where you have the right to a refund when you No-Show. Your authorization shall be effective when your air ticket is in No-Show status. When we have received the refund from the airline, we will hold that refund until you submit a refund request on the Platform or contact our customer service to claim the refund. You acknowledge that HOPS reserves the right to charge you additional service charges for processing the refund request on your behalf and in your name as such, and you may have to pay additional fees as charged by the airline. You agree that, in any case, we have no duty to pay interest or other financial benefits calculated from the refund we receive from the airline and hold on your behalf.
22.2 Hotels
22.2.1 Subject to Clause 10 (Tax), the prices set by each hotel service provider and that we have displayed on the Platform are generally room prices per night, and/or are basic services that the hotel service provider will provide directly to you, and are prices that include additional fees and service charges and related taxes, unless the hotel service provider specifies otherwise in accordance with the specific policy of that hotel. You may need to pay additional service charges, fees, or other taxes for services you receive directly from the hotel service provider during your stay, in accordance with the specific policy of that hotel. You must read the terms and conditions of the service provider you have chosen to ensure the services you will receive during the stay. In some cases, the hotel service provider strictly limits the number of guests for a hotel booking. Therefore, you must verify thoroughly to ensure that the number of guests in your hotel booking is complete according to the planned number.
22.2.2 Laws may require hotels to charge occupancy tax or local city tax to guests directly, and government authorities may announce additional tax collections, and may require hotels to charge such additional announced taxes from guests directly. You agree to pay all taxes and various expenses to the hotel directly when you check out, unless otherwise specified, and HOPS has no duty to notify you in advance of additional collection of such taxes, unless otherwise specified by law.
22.2.3 You may receive payment options for accommodation bookings on the Platform (Pay Now, or pay directly with the accommodation/hotel of the service provider (Pay at Hotel)). Please check the Booking Confirmation and follow the instructions specified in such Booking Confirmation.
22.3 Attractions and Activities
22.3.1 The prices of attractions and activities displayed on the Platform are prices set by each Partner Service Provider. You may have to make additional payments to receive other additional services, service charges, or related taxes at the attraction, in accordance with the policy of each Partner Service Provider.
22.3.2 You must verify and understand the various agreements and conditions set by Partner Service Providers, as notified or published on the HOPS Platform, to ensure the level of service you will receive at such attractions and activities. You acknowledge that you must comply with the Product Conditions and amended agreements, and/or new agreements set by each Partner Service Provider for receipt of such service.
22.3.3 The following provisions apply in cases where you book or purchase tickets or admission passes to events (including but not limited to concerts, fairs, or various festivals):
22.3.3(1) You acknowledge that various changes regarding the event are the responsibility of the organizer, and are subject to the discretion of the organizer. The above changes may include changes to the details of services and amenities at the event, the lineup of performers, the date or location of the event, tickets or admission passes for the event, the use of tickets or admission passes for the event, performance details and program, seating chart, and other matters related to the event.
22.3.3(2) You acknowledge and agree that HOPS is not involved in, does not participate in, and does not control the organization of the event. The organizer alone shall have the duty to organize, manage, and control the event. Travelloka shall not be responsible for accidents or various inconveniences you experience, whether before, during, or after the event. Such accidents or inconveniences arise from the willfulness or negligence of the organizer, including but not limited to incomplete or incorrect installation of various equipment, excessive number of attendees at the event, riots, inability to control crowds, or other reasons that cause damage to you.
22.4 Financial Services
Insurance
22.4.1 We may advertise or market the insurance products of certain insurance companies on our Platform, to the extent permitted by applicable laws and regulations, whether in the form of additional services to a Product you book or purchase, or as standalone policies. The insurance you purchase is purchased directly with the insurance company you have chosen.
22.4.2 When you access the Platform and choose to purchase insurance offered on the Platform, you acknowledge and understand that HOPS is not the insurer, does not issue or send insurance policies to you, and we do not guarantee any actions of insurance companies that own the products and provide insurance directly to you. We offer all insurance products on the Platform jointly with insurance companies authorized by the relevant regulators.
22.4.3 You have the duty to verify the conditions of the insurance product for your benefit, which the insurance company has set on the Platform, before you proceed to purchase such product.
22.4.4 The insurance company will communicate, take action, and deal with you directly regarding any activities related to the insurance product, including issuance of the policy, insurance agreement, premiums, coverage, claims, and various inquiries from you.
22.4.5 If the insurance company accepts the insurance request as you have requested, or approves your insurance application, you will receive the insurance policy by your email in the form of an electronic policy, or in any other form that the insurance company will notify you while you choose to purchase such insurance.
22.4.6 The insured must submit various documents and requests to claim compensation to the insurance company directly in accordance with the conditions of the product. HOPS may assist with contacting between you and the insurance company in cases where applicable law permits, but we have no authority to consider and decide on your claim, or any involvement in the processing, consideration, and outcome of consideration of your claim.
22.4.7 You agree to be bound by the conditions of the insurance products offered by the insurance companies, and our advertising and marketing on the Platform.
22.5 Land Transportation
22.5.1 The price of Products displayed on the Platform is the price set by each Partner Service Provider, and you may have to make additional payments to receive other additional or supplementary services, service charges, or related taxes at the location, in accordance with the policy of each Partner Service Provider.
22.5.2 You must verify and understand the various agreements and conditions set by Partner Service Providers, as notified or published on the Platform. You acknowledge that, when you proceed to book Products on the Platform, you must comply with the Product Conditions and amended agreements, and/or new agreements set by each Partner Service Provider for receipt of such service.
22.5.3 Car Rental Services (Self-drive)
22.5.3(1) After you book a car rental service (self-drive) on the Platform, you must take various actions in accordance with the procedures set by the Partner Service Provider, which may include verification of various histories, submission of relevant documents, and providing your contact information. The Partner Service Provider reserves the right to refuse the booking or cancel the booking, if you do not comply with the procedures set by the Partner Service Provider, or the Partner Service Provider has examined your various information, you do not have full qualifications, or you do not pass the verification according to the policy of the Partner Service Provider. In this case, we will refund payment for the car rental booking, but you will not be entitled to any compensation or damages. You acknowledge and agree that HOPS has no authority to consider and decide regarding the verification process of the Partner Service Provider, and such action is at the sole discretion of the Partner Service Provider. You agree to accept the risk, responsibility, and outcome of verification by the Partner Service Provider.
22.5.3(2) You shall be responsible for the car you rent throughout the rental period, and shall be responsible for any loss or damage that occurs to your belongings during the rental period, including traffic fines, or any accidents that occur to the car or property, injury or harm to body, whether minor or major, or death of you, the car renter, the driver, passengers, or any persons. HOPS shall have no liability whatsoever in such matters during the period you rent the car. However, we will assist you well by communicating with the Partner Service Provider regarding various assistance to you.
22.5.3(3) If the result of the investigation finds that the various accidents arose from defects or unavailability of the rental car, or the rental car is not in standard condition, you acknowledge that you may receive damages or compensation in accordance with the order of government authorities, or as specified in the service contract between you and the Partner Service Provider.
23. General Provisions
23.1 In cases where you use the Platform, or book or purchase any Product on behalf of or in the name of another person, such as family members or travel companions, you shall be liable if you provide inaccurate or incomplete information about those persons. In addition, you must inform the other person of these Terms and the related Product Conditions in their entirety, when the Platform is used on behalf of or in the name of another person. You agree to indemnify and defend HOPS against any losses, damages, lawsuits, and claims, including legal fees arising from or related to any breach of these Terms or your negligence and/or that of other persons.
23.2 These Terms are prepared in multiple languages. In the event of conflict between different language versions of the Terms, the Thai version shall prevail over other languages.
23.3 At any time when one party does not require the other party to comply with these Terms, this shall not be interpreted as that party waiving any rights that may be claimed under these Terms regarding breach of contract or other rights under these Terms, or waiving any rights that may arise from continued, successive, or repeated violations of any clause, or any other clauses by such party.
23.4 In the event that any provision is unenforceable or void, such provision shall be enforceable only to the extent permitted by applicable law, and such provision shall not affect the validity and enforceability of the remaining provisions. A provision equivalent to the original provision or original intent shall be used, to the extent possible, to replace the unenforceable portion. Our failure to act, or delay in acting on any rights specified in these Terms, shall not be deemed our waiver of various rights under these Terms, and we shall continue to have the right to take any actions under these Terms in the future.
23.5 HOPS may send notices or communications to you by general notice on the Platform, or send to your email address, or other contact channels as you have notified when you made the booking, or as specified in your User Account.
